Congress failed to pass legislation that would have permitted Bankruptcy Court Judges to modify homeowner mortgages in Chapter 13 cases.  Consequently, the only mortgage modification my office offers is limited in scope to that which is currently permitted under existing bankruptcy law and that which exists solely in the context of a Chapter 13 Bankruptcy proceeding or by agreement with a foreclosing lender as part of a foreclosure defense settlement.  My office does not participate in any of the homeowner mortgage loan modification programs offered by the government.  Currently, bankruptcy law permits a mortgagor to cure late mortgage payments on a principal residence over a period of up to 5 years by making monthly bankruptcy plan payments as part of a Chapter 13 case.  The Bankruptcy Court does not have the power to forgive any portion of the mortgage balance or to reduce the monthly mortgage payment on a debtor's principal residence.  Proponents of such legislation continue efforts to obtain Congressional passage of more favorable consumer-friendly mortgage treatment, and I will post information at this site if the law changes in the future.  Before you select any mortgage modification service you should check out that particular company through the Better Business Bureau and the Illinois Division of Banking.
